Insurance Coverage

Insurance policies can be among the most complex of contracts. We are recognized for our expertise in this area of the law. Appeals

Few legal matters proceed from an initial dispute through trial and appeal. As a result, this area of law is one in which it is difficult to develop expertise. Members of our firm have practiced in this area for over 20 years, and have developed familiarity with the process and procedure associated with this legally technical area of practice. Construction Defects

Claims involving buildings implicate a broad variety of technologies, materials, products, trades and professions. Tucker Holmes has experience dealing with construction defect claims premised upon architectural design, engineering, planning, and all phases of construction activities. These claims can involve damages to the premises and buildings themselves, including collapse, instability, erosion, and moisture intrusion, as well as personal injuries and other property damage associated with events such as gas explosions, mold development or toxic exposures in single family dwellings, commercial buildings or multi-unit projects. Bad Faith Disputes

Extra-contractual claims, including common law bad faith claims and statutory claims of unreasonable delay or denial, can arise throughout the claims handling process and are commonly asserted in Colorado. Our firm has built a strong reputation in this practice area through jury trial experience in both state and federal courts as well as effective argument at the appellate level. Product Liability

When products cause personal injuries or property damage, the management of the resulting litigation requires expertise in a variety of areas of the law: torts, contracts, the Uniform Commercial Code, and both general and a variety of specialized Colorado statutes. When the products are incorporated into parts of buildings, familiarity with real estate transactions and real property law is necessary. We have personnel with technical degrees who can facilitate understanding and communication among clients, insurers and experts regarding these laws and the technical subjects usually involved.
